1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your use of eversteadacademy.com and the services offered through it by Everstead Academy (“Everstead,” “we,” “us,” or “our”), including our interest list, inquiry and application forms, online payments, text messaging and email communications, and careers portal.

By using the website or submitting information or payments through it, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website.

2. About Everstead & Pre-Launch Information

Everstead Academy is an online private middle school preparing to serve students in grades 6–8 beginning in August 2027. Founding enrollment opens in January 2027.

Because we are preparing to open, program details described on the website—including curriculum, career pathways, schedules, the academic calendar, planned tuition, and staffing—represent our current plans and may change before or during the founding school year. We will communicate material changes to enrolled and interested families.

3. Eligibility & Use by Families

The website is intended for parents, legal guardians, job applicants, and other adults. You must be at least 18 years old to submit forms or make payments. When you submit information about a student, you confirm that you are the student’s parent or legal guardian or are authorized to act on their behalf.

Administrative areas of the website are restricted to authorized Everstead staff. Attempting to access them without authorization is prohibited.

4. Interest List, Admissions & Enrollment

• Joining the Founding Family Interest List does not create an application, reserve a seat, or guarantee admission.
• Making a seat reservation or enrollment deposit holds a place for your student in the founding admissions process but does not by itself guarantee admission. Admission is subject to Everstead’s admissions process, eligibility requirements, and available capacity.
• Enrollment may be subject to a separate enrollment agreement. If an enrollment agreement conflicts with these Terms, the enrollment agreement controls for enrolled students.
• You agree to provide accurate and complete information and to update it if it changes.

5. Tuition, Payments & Fees

• Online payments currently available are the $250 Founding Seat Reservation and the $1,000 Enrollment Deposit. A $250 seat reservation is applied toward the $1,000 enrollment deposit.
• All amounts are in U.S. dollars. Applicable taxes, if any, are calculated at checkout.
• Payments are processed securely by our third-party payment processor, Stripe. By submitting a payment, you authorize Everstead and Stripe to charge the payment method you provide for the amount shown at checkout, and you confirm that you are authorized to use that payment method.
• Published tuition amounts are planned founding tuition and are subject to the terms of your enrollment agreement.
• You will receive an email confirmation after a successful payment. Please keep it for your records.

6. Refund Policy

• If Everstead cancels the founding school year, or delays the opening of the school beyond the published first day of the 2027–2028 school year (August 16, 2027), each affected family may choose either (a) a full refund of all seat reservation and enrollment deposit payments, or (b) to keep the full amount as a credit toward a later start date.
• If Everstead cancels or delays the opening, we will notify affected families by email and explain how to make your selection.
• Approved refunds are issued to the original payment method.
• Withdrawing your student, declining an offer of admission, or choosing not to enroll does not qualify for a refund.
• If you have a question about a charge, please contact us at admin@eversteadacademy.org before disputing it with your bank or card issuer so we can help resolve it.

7. SMS / Text Messaging Terms

Everstead Academy offers optional text message updates about founding enrollment, admissions, events, appointments, interviews, and school updates. You can opt in by checking the “text me updates” box on our forms.

• Opting in is optional and is not a condition of enrollment, employment, or any purchase.
• Message frequency varies. Message and data rates may apply.
• Reply STOP at any time to opt out. You will receive one confirmation message, and then no further text messages unless you opt in again.
• Reply HELP for help, or contact us at admin@eversteadacademy.org or (256) 300-2686.
• Carriers are not liable for delayed or undelivered messages.
• You agree to notify us if you change or deactivate the mobile number you provided.

Our handling of mobile information is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

8. Careers & Job Applications

Submitting a job application does not guarantee an interview or offer of employment. Job postings may be changed or closed at any time. You agree that the information you submit is accurate and that you are authorized to share it, and you agree not to include confidential information belonging to current or former employers. Any offer of employment is subject to a separate written agreement.

9. Acceptable Use

When using the website, you agree not to:

• Submit false, misleading, or fraudulent information or payments.
• Upload files containing viruses, malware, or other harmful code.
• Use automated tools to submit forms, scrape content, or interfere with the website’s operation or security.
• Attempt to gain unauthorized access to any account, system, or data.
• Use the website in violation of any applicable law or regulation.

We may block access, reject submissions, or cancel transactions that we reasonably believe violate these Terms.

10. Intellectual Property

All content on the website—including text, graphics, logos, the Everstead name and shield, photographs, and downloadable documents—is owned by or licensed to Everstead Academy and is protected by intellectual property laws. You may view and print content for personal, non-commercial use related to your family’s or your own interest in Everstead. Any other use requires our prior written permission.

11. Third-Party Services & Links

The website relies on third-party services, such as payment processing and sign-in providers, and may link to third-party websites. Your use of those services is subject to their own terms and privacy policies. Everstead is not responsible for third-party websites or services.

12. Disclaimers

The website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Everstead disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be uninterrupted, error-free, or free of harmful components. Information about future programs, outcomes, certifications, and credentials is not a guarantee of any particular result.

13. Limitation of Liability

To the fullest extent permitted by law, Everstead and its founders, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website. Everstead’s total liability for any claim relating to the website or these Terms will not exceed the amount you paid to Everstead through the website in the twelve months before the claim arose.

14. Indemnification

You agree to indemnify and hold harmless Everstead and its founders, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the website.

15. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the website will be brought exclusively in the state or federal courts located in Madison County, Alabama, and you consent to the jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and revise the “Last updated” date. Changes apply from the date posted; payments made before a change remain subject to the Terms in effect at the time of payment.
